Under the current Worker’s Compensation and Rehabilitation Act 2003, you now have the opportunity to access rehabilitation and return to work services through an external provider. No longer is it necessary for your Rehabilitation and Return To Work Coordinator to be an employee of your organisation. Legislative Compliance – Organisational simplified and cost effective

  • Rehabilitation and Return to Work Coordinator 
    Prime will allocate trained and registered Rehabilitation and Return To Work Coordinator/s to your organisation.

    Worker’s Compensation and Rehabilitation Act 2003 – Section 226:

    • "(1) An employer must appoint a rehabilitation and return to work coordinator if the employer meets criteria prescribed under a regulation."
  • Workplace Rehabilitation Policy and Procedures
    Prime will update your organisation’s Workplace Rehabilitation Policy and Procedures to comply with your outsourced model, and thus maintain accreditation.

    Worker’s Compensation and Rehabilitation Act 2003 – Section 227:
    • "(1) The employer must have workplace policy and procedures …"
    • "(4) The employer must review the employer’s workplace rehabilitation policy and procedures at least every 3 years and must comply with reporting requirements as prescribed under a regulation.”
  • Provider Approval
    Q-COMP approval of the outsourced provider is mandatory. Prime will attend to this compliance requirement through communicating and registering directly with Q-COMP.  
  • Rehabilitation and Return To Work Coordinator Contract
    Prime will provide evidence of this service agreement through a written contract. Note this contract will act as evidence of your organisation's compliance and will be provided to Q-COMP and WorkCover Queensland when required.

        Worker’s Compensation and Rehabilitation Act 2003 – Section 226:

    • “(2) The rehabilitation and return to work coordinator must be in Queensland and be employed by the employer under a contract …"

Legislative Compliance – Training

Understanding worker’s compensation and the rehabilitation process

Worker’s Compensation and Rehabilitation Regulation 2003 Division 3 Sections 109 – Standard for Rehabilitation:

  • “(3) The worker’s employer must ensure rehabilitation for a worker is coordinated with and understood by line managers, supervisors and coworkers.”

Prime is offering a customised half-day training course designed to assist organisations with the Return To Work processes, as well as the roles and responsibilities associated with this outsourced model. The course is an important value-add component of our Rehabilitation (Return to Work) Coordinator programs and it is recommended that one or two of your staff (management and/or administration) participates in this informative course.

The course will include:

  • An overview of rehabilitation as set out in the current Worker’s Compensation and Rehabilitation Act 2003;
  • Guidance through the documentation and how it will assist your organisation;
  • Early Intervention – how it will reduce your insurance premium;
  • Rehabilitation processes from injury to recovery: simple through to complex cases;
  • Advice Line – how your organisation can utilise this service to its optimum;
  • Up to date information on worker’s compensation within the state of Queensland.

Worker’s Compensation and Rehabilitation Act 2003 – Section 133

  • “(1) An employer … whose worker sustains an injury for which compensation may be payable must complete a report in the approved form and send it to the nearest office of WorkCover.”
    • Focus will be given to providing your employees with the knowledge and skills necessary to effectively undertake the obligation as stated in Section 133 (above). Support will be maintained via the Advice Line.

Advice Line – our professional support to you

Prime have expert knowledge and experience in the Queensland worker’s compensation system. Our Advice Line will provide free information and support to your organisation in relation to worker’s compensation and rehabilitation enquiries. This information falls into two categories:

  • Up to date information on WorkCover current processes;
  • Fault and employer liability issues;
  • Employer and worker rehabilitation obligations;
  • Factors that will impact on your worker’s compensation insurance premium. 

Claim Specific – injured worker

  • How will this injury impact on the individual?
  • Will this injury require rehabilitation intervention?
  • When is it necessary to complete WorkCover documentation?
  • Interpreting Medical Certificates
  • Development of return to work plans where injuries are minor.

FACE TO FACE CONSULTATION
The Advice Line consultant may at times recommend a “face to face” consultation in relation to management of complex cases.

 

Rehabilitation Processes – early intervention

  • Worker’s Compensation and Rehabilitation Act 2003 – Section 228:
    • “(1) The employer of a worker who has sustained an injury must take all reasonable steps to assist or provide the worker with rehabilitation for the period for which the worker is entitled to compensation.
    • “(2) This rehabilitation must be of a suitable standard as prescribed under a regulation.”

Prime is an integral part of rehabilitation interventions within Queensland, providing services for employers both in the private and public sectors.

  • Worker’s Compensation and Rehabilitation Regulation 2003 - Division 3 Standard for Rehabilitation:
    • “106 (1) An employer must develop a suitable duties program for a worker undertaking rehabilitation.
    • “109 (1) Rehabilitation must be goal directed with timely and appropriate service provision having regard to

      -    the workers injury; and

      -    the objectives of the rehabilitation and return to work plan; and

      -    the workers rate of recovery.

    When it has been identified by the employer or outsourced Rehabilitation and Return To Work Coordinator that a rehabilitation intervention is required, the following return to work services can provided to the injured worker.

  • Rehabilitation Assessment and advice;
  • Development of Return To Work Plan and Suitable Duties Program;
  • Consultation with injured worker, treating medical practitioner, health professionals, WorkCover Queensland and supervisor/team leader;
  • Monitoring and upgrading of Return To Work Plan;
  • Case closure and feedback from injured worker.

Prime, as part of our service provision, will provide expert advice and recommendations on those cases where “return to work/same employer” may not be feasible due to the injury, work demands or industrial relations climate. Our coordinators have extensive experience in human resource procedures required to successfully redeploy individuals. We understand the sensitivity associated with this process and always ensure that the individual is assisted in a professional manner.
